Lately, in Oregon our background checks have been coming up delayed for more than three days. Sometimes the purchaser has had to wait several months to get approved. Dealers are reluctant to release the gun to the buyer after the three day period because the background check has not been finished.
So what happens if a buyer has paid his money and is denied the gun or delayed, and the buyer wants his money back? What if the buyer bought the gun from an online dealer who has a policy of " All sales are final". Would the dealer be required to return the money, or would the gun be in limbo? |

If the local dealer refuses to make the transfer despite no legal justification, I'd say you have a case against that dealer. I'd call the police -- he's STOLEN your property.
The better scenario is to discuss this possibility with both parties prior to the sale. |

I was going to point out a few options, but then the post would be interpreted by at least one in Wyoming to be in violation of the sites rules. Yes 08 some do know how to read. |

When I had an FFL, if I remember correctly, if the sale was delayed you were free to finish the transfer after the three day waiting period. As long as the didn't come back to you with a denied. Now it's all done on computer so no phone calls necessary. It has been a while since then though. |

if OTHER JURISDICTION AREN'T HAVING THE SMAE DELAY I SUSPECT YOU HAVE A LOCAL PROBLEM THAT NEEDS ADDRESSING. I HAVEN;T HEARD OF ANY ISSUES IN EITHER NY OR FL. |

If this is truly a widespread problem in Oregon then it may be time to get the NRA involved. Minnesota has its own very active gun owners rights group.
